Terms of Service

The short version
GolfRx is a structured wellness program that uses golf as the training ground. It is not therapy, not medical care, and not a substitute for either. You pay a monthly subscription. Some plans include a reimbursement allowance you can use toward golf-related expenses. If you complete an assessment with a licensed clinician, you may receive a Letter of Medical Necessity that supports HSA/FSA reimbursement — but we don’t decide what your HSA administrator will or won’t reimburse, and we don’t advise you on taxes.
You agree not to abuse the platform, share your account, or use it for anyone under 18. You can cancel anytime. Disputes go to arbitration in Minnesota.
The rest of this document spells those things out.
1. Agreement to terms
These Terms of Service (“Terms”) govern your access to and use of the GolfRx platform, including the website at gogolfrx.com, the dashboard at dashboard.gogolfrx.com, and any related services (collectively, the “Service”) operated by GolfRx LLC, a Minnesota limited liability company (“GolfRx,” “we,” “us,” or “our”).
By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you don’t agree, don’t use the Service.
These Terms form a binding contract between you and GolfRx LLC.
2. Eligibility
You must be:
- At least 18 years old
- A resident of the United States
- Legally able to enter into a binding contract
- Not prohibited from receiving services under applicable law
By creating an account, you represent that all of the above is true.
3. What GolfRx is and isn’t
What it is
GolfRx is a structured mental performance and lifestyle optimization program delivered through golf. The program uses CBT-based frameworks, structured exercises, monthly self-assessments, an AI coach, and (optionally) assessments with licensed clinical professionals to help members improve focus, resilience, emotional regulation, and overall well-being.
What it isn’t
GolfRx is not medical care, mental health treatment, psychotherapy, or counseling. It is not a substitute for any of those things. The questionnaires (GAD-7, PHQ-9) we use are widely available self-assessment tools that we use to personalize the program — they are not clinical diagnoses, and the scores they produce don’t constitute medical advice.
The AI coach is not a therapist, doctor, or licensed professional. It does not provide medical advice. If you’re experiencing a mental health crisis, contact a licensed provider or call 988 (the Suicide and Crisis Lifeline) immediately.
If you have a condition that requires medical care, get medical care. Use GolfRx alongside it, not instead of it.
4. Your account
Creating an account
You’ll create an account with an email and password. You’re responsible for keeping your password secure and for everything that happens under your account.
One person per account
Accounts are for individual use. Don’t share your account credentials, don’t let others use your account, and don’t create accounts on someone else’s behalf without their permission.
Accurate information
You agree to provide accurate, current, and complete information when creating your account and to keep it updated.
Account termination
You can delete your account at any time from your account settings or by emailing us. We can suspend or terminate your account if you violate these Terms, if your payment fails, or if we reasonably believe your activity is harmful to us or other members.
5. Membership, billing, and trials
Subscription plans
GolfRx offers multiple membership plans. Plan features, prices, and reimbursement allowances are described on the pricing page at the time you sign up. We may change plan terms going forward, but changes apply only to future billing cycles, not your current paid period.
Trial period
If your plan includes a free trial, you’ll have full access for the trial period. We’ll start billing your card when the trial ends unless you cancel before the trial period expires.
Billing cycle
Subscriptions bill monthly on the date you signed up, on the first of each month, or as specified at signup. You authorize us to charge your payment method on file for each billing cycle until you cancel.
Payment processing
All payments are processed by Stripe. We don’t store your card details on our servers. Your use of Stripe is governed by Stripe’s own terms and privacy policy.
Plan changes
You can change your plan from your account settings. Some changes apply immediately (with proration); others apply at the start of the next billing cycle. The specifics are explained when you make the change.
Cancellation
You can cancel anytime from your account settings. When you cancel:
- You retain access to the program for the remainder of your current paid period
- We don’t refund partial months
- Any unused reimbursement allowance for the current cycle is forfeited at the end of the cycle
- Your data remains in our system per our Privacy Policy unless you also request deletion
Refunds
We don’t generally offer refunds for paid months. If something has gone seriously wrong, email us at support@gogolfrx.com and we’ll review the situation case by case.
Failed payments
If a charge fails, we’ll retry it and notify you. If the payment isn’t resolved within a reasonable period (typically 14 days), we may suspend your account until billing is current.
6. Reimbursement and HSA/FSA
What the reimbursement allowance is
Some GolfRx plans include a monthly reimbursement allowance that you can apply toward golf-related expenses you incur (greens fees, club memberships, lessons, equipment — as defined within the program). The allowance amount, how to claim it, and what qualifies are described in your member dashboard.
How it works
Each month, you submit an attestation confirming you used your golf time as part of the GolfRx program. After you submit the attestation, your reimbursement is processed via the payment method on file.
HSA / FSA eligibility
If your plan includes a clinical assessment pathway, you may receive a Letter of Medical Necessity from a licensed clinician affiliated with GolfRx. This letter can support reimbursement of GolfRx-related expenses from a Health Savings Account (HSA) or Flexible Spending Account (FSA) under IRC Section 213(d).
Important disclaimers:
- We do not provide tax, legal, or financial advice. We provide documentation — what your HSA or FSA administrator does with that documentation is up to them and your specific circumstances.
- HSA/FSA reimbursement eligibility depends on facts specific to your situation, your tax position, your plan administrator’s policies, and applicable law.
- A Letter of Medical Necessity does not guarantee reimbursement.
- We strongly recommend you consult your own tax advisor or CPA before relying on HSA/FSA reimbursement.
- Misuse of HSA/FSA funds can result in tax penalties. That’s between you, your administrator, and the IRS — not us.
7. The clinical pathway
GolfRx contracts with licensed mental health professionals in multiple states. If you opt into the clinical pathway:
- You’ll complete an assessment with a licensed clinician
- The clinician makes their own professional judgment about whether to issue you a Letter of Medical Necessity
- The clinician is a licensed professional in your state and operates under their state’s licensing requirements and ethics rules
- Your interactions with the clinician (the assessment itself, the issued letter) are governed by the clinician’s own privacy practices, which are typically stronger than GolfRx’s general practices
GolfRx is not the clinician’s employer for the purposes of professional liability — the clinician is independently licensed and responsible for the professional services they provide. We pay the clinician for performing the assessment.
8. The AI coach
The AI coach is powered by Anthropic’s Claude AI. It uses your exercise responses, monthly check-ins, and conversation history to give relevant, personalized responses.
What the AI coach is not
It is not a therapist, not a doctor, not a counselor, and not a licensed professional of any kind. It is an AI assistant trained to reflect GolfRx’s program content back to you in conversation.
Limitations
- The AI coach can be wrong. Don’t rely on it for any decision that matters.
- The AI coach is not a substitute for professional medical or mental health care.
- Conversations are logged and may be reviewed by GolfRx staff for quality assurance.
- We rate-limit AI coach usage to protect against abuse and runaway costs.
Crisis situations
The AI coach is not built for crisis intervention. If you’re in crisis, contact 988 (the Suicide and Crisis Lifeline) or your local emergency services immediately.
9. Your conduct on the platform
You agree not to:
- Use the Service for any unlawful purpose
- Share your account credentials or let anyone else use your account
- Attempt to access another member’s account or data
- Reverse-engineer, scrape, or programmatically access the platform beyond normal use
- Submit false information in your attestations or claim reimbursements for expenses you didn’t incur
- Abuse the AI coach (spam, prompt injection, attempting to bypass content guidelines, generating content for unrelated purposes)
- Upload malicious content or attempt to compromise platform security
- Use the Service to harass, threaten, or harm other members or staff
- Resell or commercially redistribute access to the program
We reserve the right to suspend or terminate accounts for violations.
10. Intellectual property
Our content
The GolfRx program — including the modules, exercises, worksheets, naming conventions (“Birdies,” tier names, exercise names), structured frameworks, and platform design — is GolfRx’s intellectual property. You’re licensed to use it for your personal, non-commercial use as a member.
You don’t get the right to copy, redistribute, republish, modify, or create derivative works from the program content. If you want to use any of it for something else (training, teaching, business application), contact us.
Your content
You retain ownership of the content you create (your exercise responses, journal entries, AI coach messages). By submitting it to GolfRx, you grant us a license to:
- Store, process, and display it back to you within the platform
- Use de-identified aggregate patterns from it to improve the program
- Use it to personalize the AI coach for you
We don’t claim ownership of your content. We don’t sell it. We don’t use it to train AI models.
Feedback
If you send us suggestions, ideas, or feedback about the platform, you grant us the right to use that feedback without obligation or compensation to you.
11. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law:
- We make no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We don’t guarantee specific outcomes. GolfRx is a structured program designed to help with mental performance and lifestyle optimization. Whether it helps you, and how much, depends on you. We can’t promise improvements in any particular metric.
- We don’t guarantee continuous availability. The platform may be down for maintenance, updates, or unexpected reasons. We try to minimize downtime but can’t guarantee 100% uptime.
- We don’t guarantee HSA/FSA eligibility. See Section 6.
12. Limitation of liability
To the maximum extent permitted by law:
GolfRx LLC, its officers, employees, agents, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising from your use of the Service, even if we’ve been advised of the possibility of such damages.
Our total cumulative liability for any claim related to the Service is limited to the greater of (a) $100 USD or (b) the total amount you paid GolfRx in the 12 months preceding the claim.
Some jurisdictions don’t allow exclusions or limitations of certain damages, so portions of this section may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless GolfRx LLC, its affiliates, and their officers, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third party’s rights
- Any content you submit to the platform
14. Dispute resolution and arbitration
Try to resolve directly first
If you have a dispute with GolfRx, email us at support@gogolfrx.com and we’ll try to resolve it. We’re a small team and we genuinely want to fix problems before they become disputes.
Binding arbitration
If informal resolution doesn’t work, you and GolfRx agree to resolve any dispute through binding individual arbitration rather than in court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Minneapolis, Minnesota, or remotely if both parties agree.
No class actions
You and GolfRx each agree that any dispute will be resolved on an individual basis. You waive any right to participate in a class action, collective action, or representative proceeding against GolfRx.
Exceptions
This arbitration agreement does not apply to:
- Claims for injunctive relief related to intellectual property
- Small claims court actions (if eligible under applicable rules)
Opt-out
If you don’t want to be bound by this arbitration provision, email us at privacy@gogolfrx.com within 30 days of creating your account with the subject line “Arbitration Opt-Out.” Your opt-out request must include your full name, email address, and a statement that you don’t want to resolve disputes through arbitration. Opting out won’t affect your access to the Service.
15. Governing law
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles. To the extent any dispute is permitted to proceed in court (rather than arbitration), it will be filed in the state or federal courts located in Hennepin County, Minnesota, and you consent to the jurisdiction of those courts.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we’ll:
- Update the “Last updated” date at the top
- For material changes (changes to billing, dispute resolution, or your rights), notify active members by email at least 30 days before the change takes effect
- For minor clarifications, post the update without separate notification
Continuing to use the Service after a change means you accept the updated Terms. If you don’t accept, cancel your subscription.
17. Miscellaneous
Entire agreement
These Terms and our Privacy Policy are the entire agreement between you and GolfRx LLC regarding the Service. They supersede any prior agreements or communications.
Severability
If any part of these Terms is found unenforceable, the rest stays in effect.
No waiver
If we don’t enforce a provision of these Terms, that doesn’t mean we’ve waived our right to enforce it later.
Assignment
You can’t assign your rights under these Terms without our written consent. We can assign ours (for example, in connection with a sale of the business) without your consent.
